
Article 1 Definitions | Client – the individual or organization requesting services from Star Moving ATL. Contractor – Star Moving ATL, the provider of moving and logistics services. Assignment – the scope of services provided under a confirmed agreement or order between Star Moving ATL and the Client. |
Article 2 Applicability | These Terms apply exclusively to all agreements, quotations, and services provided by Star Moving ATL. Any alternative terms are valid only if explicitly accepted in writing by Star Moving ATL. Deviations apply solely to the specific assignment for which they are made. |
Article 3 Formation of the Agreement | 3.1 All quotations from Star Moving ATL are non-binding and may be modified or withdrawn prior to written confirmation. 3.2 Work begins only after a signed order confirmation and/or receipt of any required advance payment. 3.3 Prices exclude taxes, permits, or surcharges unless otherwise stated. 3.4 Changes during execution require mutual written consent. 3.5 Activities are billed based on actual hours and resources, rounded to the nearest full unit. |
Article 4 Duration and Term | 4.1 Agreements remain valid until completion or lawful termination. 4.2 Timeframes for work are approximate unless explicitly defined as fixed deadlines in writing. |
Article 5 Execution of the Assignment | 5.1 Star Moving ATL may engage subcontractors or third parties as needed. 5.2 The Client must provide complete and accurate data, documents, and access for proper execution. 5.3 The Client is responsible for the accuracy and reliability of provided information. |
Article 6 Confidentiality | 6.1 Star Moving ATL maintains confidentiality of all client-related information. 6.2 Third parties engaged by Star Moving ATL are bound by equivalent confidentiality obligations. |
Article 7 Termination of the Agreement | 7.1 Either party may terminate with one month’s written notice. 7.2 Upon termination, all completed services and expenses must be paid. 7.3 Star Moving ATL may terminate immediately in case of bankruptcy or similar conditions. 7.4 Cancellations within two weeks before the start date incur up to 50% fee; within seven days — up to full price. 7.5 Star Moving ATL may dissolve the agreement in case of force majeure without liability. |
Article 8 Payment and Billing | 8.1 Payment is due upon completion unless otherwise agreed. 8.2 For invoiced payments, settlement is required within 10–14 days of the invoice date. 8.3 Late payments incur statutory interest and collection fees. 8.4 The Client cannot offset or withhold payments due to pending claims. |
Article 9 Liability | 9.1 The Client must ensure access, permits, and safe working conditions. 9.2 Star Moving ATL is not liable for damages caused by incorrect information or unsafe conditions. 9.3 Liability is limited to direct damages proven to result from negligence. 9.4 Total liability per incident is limited to the declared or insured value. 9.5 Standard basic coverage is included; full-value protection is optional. 9.6 Damage must be reported immediately and documented before movers depart. 9.7 Exclusions: plants, animals, unpacked items, antiques, fragile electronics, or natural wear. 9.8 All claims require proof of value or receipt. |
Article 10 Personnel Non-Solicitation | The Client may not hire or engage Star Moving ATL employees or contractors during the service period and for 12 months after. Violation results in a €5,000 fine plus possible compensation for losses. |
Article 11 Force Majeure | In case of uncontrollable events (e.g., natural disasters, strikes, government restrictions), Star Moving ATL may suspend or cancel services without liability. |
Article 12 Governing Law and Dispute Resolution | 12.1 All agreements are governed by the laws of Star Moving ATL’s jurisdiction. 12.2 Both parties will attempt amicable settlement before legal action. If unresolved, disputes are subject to the competent court in Star Moving ATL’s jurisdiction. |
Final Provision
By confirming an order or assignment with Star Moving ATL, the Client acknowledges having read, understood, and agreed to these General Terms and Conditions in full.
